We comply with all laws and regulations regarding privacy. In this privacy statement we provide you with information on how we process your personal data.

Categories of personal data

In the performance of our services we process personal data. Sometimes we get these personal data from you, in other cases we collect the data while performing our services.

We can process the following categories of data:

  • Name;
  • Address;
  • Registration number Chamber of Commerce;
  • VAT number;
  • Telephone number or numbers;
  • Email address;
  • Fax number or numbers;
  • Other personal data needed for the performance of our services which we cannot foresee at the moment; this could include personal data of our clients or personal data of third parties; or
  • Personal data we obtain from your opposing party in case we assist or represent your oppoosing party in a legal dispute; this could include health-related data or data on allegations or convictions of criminal behavior.
  • Limited tracking data of visitors to our website. We only measure traffic within our own site and do not share this data with anyone; all processing is done on our own servers only. In addition, we anonimize the IP address data: the last 2 octets of the IP address are deleted.

Legal basis for processing

We can only process your personal data if there is a legal basis to do so. Our legal bases are:

  • Consent (Article 6 sub 1(a) GDPR);
  • Necessary for the execution of a contract between you and us (Article 6 sub 1(b) GDPR);
  • Necessary for the execution of a legal obligation (Article 6 sub 1(c) GDPR);
  • Necessary for the purposes of a legitimate interest of us or one of our clients (Article 6 sub 1(f) GDPR);
  • Necessary for the establishment, exercise or defense of legal claims (Article 9 sub 2(f) GDPR).
  • Necessary for the purposes of our own legitimate interest (Article 6 sub 1(f) GDPR) when performing tracking of traffic to and within our website. Details of this tracking can be found on our disclaimer page.

Sources

We use the following sources for personal data which we do not obtain directly from you:

  • Your opposite party in a legal dispute, or
  • Analyses that we run in the performance of our work.

Purposes of the processing

We process personal data for the following purposes:

  • Performance of a contract between you or your company and us;
  • Performance of a contract between a third party and us necessitating the processing of your personal data;
  • Acquisition of new clients.

Verstrekking van uw persoonsgegevens aan derden

In principle, we will not transfer your personal data to third parties without your consent. There are, however, some exceptions to this rule:

  • In the context of a legal dispute, for instance when we need specific expertise for the establishment or execution of, or the defense against, a claim;
  • If required to do so by a legal obligation;
  • As part of our backup procedure – we use off-site storage of encrypted backup data at a secure location in The Netherlands.

Data retention

We will not process or store your personal data longer than needed for the above listed purposes, unless required by law. Financial and fiscal data will be stored for a minimum of 7 years. Other data will be processed or stored as long as necessary to ensure the continuity of our business and/or in order to establish, exercise or defend a legal claim or during our defense against such a claim.

Your rights

You have certain rights regarding the processing of your personal data. This includes the right of access to the data, the right to rectification, and the right to be forgotten. You can also request to have your personal data transferred to a third party or to limit the processing of your personal data. You can also object against the processing of your personal data. Submit a complaint with the supervisory authorities

In case you are not happy with our processing of your personal data, you can submit a complaint to the supervisory authority. Normally, this will be the Dutch "Autoriteit Persoonsgegevens". Changes to this Privacy Statement

We reserve the right to make changes to this Privacy Statement. All changes will be published on this web page. We therefore advise you to consult our website from time to time.

Automated decision-making

We do not use your personal data for any kind of automated decision-making.  Therefore, articles 21 and 22 GDPR are not applicable.
